The firm also appeared before the International Trade Commission in a patent litigation case, successfully settling the matter and procuring a license to the Complainant’s patent portfolio.

In 2011, the firm helped a Fortune 500 corporation achieve a decisive victory in a London trial concerning its decision to cease its support for a high-profile product acquisition. • Issues & Crisis Management

An important component of our model is public advocacy.

We believe that effective client advocacy is driven by the ability to represent our clients’ interests not just in the courtroom – but beyond. As such, we regularly represent clients in the regulatory arena, the legislative environment, and the news media. In all of these forums, we are defined by our ability to achieve extraordinary results – and to innovate in pursuit of them.

We formed one of the first in-house strategic communications practices within a national litigation firm. Today, this public relations and communications practice group advises clients on a broad array of reputational issues, political and regulatory concerns, and image-building opportunities. We routinely advise clients ranging from Fortune 500 global corporations to enterprising start-up ventures.

Our team of communications professionals specializes in issues & crisis management and has extensive experience with representing clients in a broad range of public issues that can impact their most valued asset – their brand.

Our advocacy helps clients respond to media inquiries, congressional investigations, regulatory concerns, proactive campaigns, management changes, and interactions with non-governmental organizations (NGOs).

Whether it’s directed at shareholders, customers, regulators, business partners, opinion leaders, or employees, our firm understands that the most effective client advocacy often extends beyond the courtroom – and into the court of public opinion.

    REPRESENTATIVE PR MATTERS

    • The firm currently represents a Fortune 500 company in an environmental lawsuit that seeks more than $1 billion in damages. Central to the firm’s advocacy is its management of public relations issues and regulatory concerns involving the company. The firm represents the company in dealings with the local and national financial media, regulators, community organizations, and non-governmental organizations (NGOs) – helping the company navigate reputational issues, establish public goodwill, and protect its most valued asset, its brand.
    • For the same Fortune 500 company, the firm successfully directed a communications strategy that ended more than three years of public and regulatory opposition to a hazardous waste permit. The firm engaged political leaders, directed town hall meetings, managed media relations, and oversaw communications with local regulators to help the company secure the permit amendment – and save almost $2 million annually in its waste treatment costs.
    • The firm currently manages public relations in connection with one of the most celebrated real estate projects in New York City – the transformation of the Kingsbridge Armory in the Bronx. The firm has helped engineer a grassroots and media relations strategy to help the developer confront and overcome political opposition, gain approval from the New York City Council, and ultimately help ensure the successful undertaking of this historic project.
    • The firm successfully represented a major university in connection with a congressional inquiry relating to its compensation policies. Working with congressional staffers, senior levels of the university administration, and Tier I media outlets like The New York Times, the firm successfully resolved the inquiry and helped the university neutralize public backlash. By doing so, the firm assisted in protecting the global brand of the institution; restoring the confidence of faculty, alumni, and donors; and positioning the university favorably with key stakeholders.
    • The firm managed a media and public relations campaign for the high-profile takeover of a chain-managed hotel property in Hawaii. The campaign involved local, regional, and national media, and allowed the hotel owner to control the narrative in one of the most high-profile disputes in the hospitality industry. By directing key communications and engaging with the press, the firm was able to effectively position the hotel owner with employees, vendors, customers, and investors. Under a new name, the hotel emerged as a viable asset – and became recognized as one of the most prominent resorts in the local marketplace.
    • The firm represented a leading defendant in connection with the New York Attorney General’s highly-publicized investigation and prosecution of allegations of corruption in the Office of the New York Comptroller and the New York State Common Retirement System. The firm directed a national media relations effort that neutralized public attacks and helped our client restore his good name. The strategy allowed our client to emerge from a public relations crisis and continue his involvement in a wide range of business and philanthropic interests.
    • Under the Voting Rights Act of 1965, the firm has engineered a wide range of advocacy campaigns to give a voice to Latino voters and other communities of interest challenging discriminatory electoral schemes. The firm’s courtroom and public advocacy has resulted in sweeping change to voting schemes across Texas – and informed electoral bodies across the nation.
    • The fight for survival of Jim’s Shoe Repair became a closely-followed campaign – emblematic of the struggle faced by small businesses swept away in the “corporatization” of New York City. Faced with losing its 1,000-square-foot shop in Midtown to accommodate the expansion of Duane Reade, located next door, Jim’s engaged the firm to engineer a public advocacy campaign to help save the business. A grassroots petition drive, a high-profile PR campaign, and a social media effort generated a wave of public support – allowing the business to successfully challenge eviction and secure a new lease agreement for the location it has called home for almost 70 years. Using this issue as a case study, elected officials have now introduced New York City regulations aimed at protecting tens of thousands of small businesses.
    • The firm represented an enterprising start-up in the ride-sharing industry – a multi-purpose platform that is taking the on-demand economy by storm. The firm coordinated a communications and public outreach strategy in connection with key regulatory filings, to generate buzz and public awareness, and support the company’s business goals.

INNOVATIONS

  • Litigation Consulting Group

Our in-house litigation consultants are qualified to work with lawyers in complex litigation and dispute resolution matters. The firm’s Consulting Group is comprised of consultants recruited from a variety of disciplines, including finance, accounting, information technology, and economics.

The Consulting Group provides invaluable expertise, perspective, and insight into the analysis of each client’s circumstances. Because the firm’s consultants are part of the professional team involved in each client matter from the very beginning, they are able to efficiently influence and improve the strategic and substantive development of the case throughout the entire advocacy process.

  • State-of-the-Art Technology

The firm has an internal document management system in order to index, abstract, and analyze large volumes of information and case-related files. The firm utilizes a captive, offshore facility to populate the document management database.

To ensure quality control and timeliness of deliverables, the firm’s in-house document management experts conduct regular teleconferences with the offshore facility. The offshore staff is comprised of attorneys and other professionals who provide their time and services at lower billing rates.

Corporate clients pay less than half of what they would otherwise be charged for comparable services in the United States.

  • Value-Based Billing

Brewer, Attorneys & Counselors has been an innovator in developing new ways of pricing legal services to promote greater accountability, predictability, and efficiency. The firm will, on occasion, offer fee structures that are unique among law firms providing dispute resolution services to major corporations and commercial enterprises in the most significant cases.

Partner William Brewer earned widespread acclaim in the early 1990s for his promotion of innovative alternative fee arrangements (AFAs). The firm has long believed that law firms should be compensated based upon results, not just the number of hours worked. Value-based billing can be structured to define the goals of the engagement, allow the client to manage and predict costs, and incentivize the firm – making the firm and client partners in the litigation process.

In a speech at the 1992 American Bar Association Annual Meeting in Washington, D.C. and later reprinted in Vital Speeches, “The Breakdown of the Monopoly of the Bar Card,” dated March 1, 1993, Brewer commented, “The demise of the hourly system was inevitable. Clients distrust the billing methods of lawyers who bill by the hour, and with good reason…. Corporate clients are doing what anyone should expect a business to do: They are responding by initiating changes that make bottom-line business sense, and getting out from under what has been a frustrating relationship with outside counsel…. Legal services are a means to an end. Clients ultimately want results and – not surprisingly – they do not want to pay excessive legal fees to obtain those results. Clients seek predictability, accountability, and productivity.”

While the firm handles many cases on a strict hourly fee arrangement, it will continue to explore and offer value-based billing options. These pricing arrangements are often an attractive option for clients involved in complex commercial litigation.

  • Investigative Unit

Brewer, Attorneys & Counselors also formed its own in-house investigation unit. This unit has included professionals recruited from leading law enforcement organizations and private investigation firms.

The investigation unit utilizes a network of worldwide resources, computerized technology, and other capabilities to provide research and analysis that supports the firm’s legal strategies. Working in the firm’s Dallas and New York offices, these investigation professionals provide Brewer, Attorneys & Counselors with a strategic advantage – the ability to prepare for bet-the-business cases by utilizing an advanced and more intensive level of research and case analysis.

The collaborative environment of attorneys and professional investigators working together directly supports the firm’s commitment to advocacy in behalf of its clients.

  • Public Relations Expertise

Brewer, Attorneys & Counselors is unique among its competitors in that it has an in-house Public Relations Unit. The firm’s clients are often judged in the court of public opinion. Indeed, even in formal litigation, winning in the courtroom may not be enough in today’s business and regulatory environment.

The firm’s communications and public relations professionals assist clients in navigating internal and external communications challenges. By doing so, the firm helps its clients manage crisis events and capitalize on positive, image-building media opportunities. The firm also often assists in directing the management and coordination of activities taking place in the legislative arena.

COMMUNITY OUTREACH

The firm’s commitment to client advocacy is equaled only by its commitment to the community.

Storefront

Founded in 1995, the Brewer Storefront (formerly the Bickel & Brewer Storefront) seeks to make the firm’s brand of advocacy available to those without the resources to access a high caliber of legal representation.

The Storefront is particularly active on individual matters that can be used to establish legal precedent and make a long-term, positive impact on the community at large.

As an example, the Storefront’s representation on issues relating to illegal “immigration ordinances” and other unlawful measures has captured the attention of legal scholars, public policy advocates, and elected officials working to ensure that the Latino population is treated with justice, fairness, and equality.

Our firm has long believed that each of its professionals should have the opportunity to make a contribution to the community through pro bono legal service. On average, the firm’s professionals donate 200 hours per year to the Storefront.

The Storefront has earned several community service awards, including recognition at the Dallas Bar Association’s Annual Pro Bono Awards Celebration. The Storefront has earned the “President’s Award” from the Dallas Hispanic Bar Association, and has been featured in the national publication of the Pro Bono Institute in Washington, D.C.,What's New in Law Firm Pro Bono.

Among these are the Future Leaders Program, and the Brewer Foundation/New York University International Public Policy Forum.

During its history, the Foundation has also contributed more than $20 million to the community, by providing annual support to more than 60 charities working in areas as diverse as medicine, the arts, and human rights.

Guiding the Foundation’s commitment have been its partnerships with distinguished community leaders. The Foundation collaborates with leaders in education, law, business, and philanthropy in order to grow and support its mission. This support – and the spirit of community partnership it fosters – enables the Foundation to bring immediate benefits to the community, while building programs that will generate long-term, positive change.

Members of the community are invited to support the Brewer Foundation – investing in our educational programs and the students they serve. To make a donation to the Future Leaders Program, please click here. To make a donation to the International Public Policy Forum, please click here.
